If you do not agree to these Terms, you may not use our Services.
Homestaurants.com is a non-profit association. Our role is limited to providing an online platform where home-based cooks (“vendors”) can present and offer meals to customers. We do not prepare, deliver, or handle payments for any food or orders.
1. Using Our Services
1.1 Eligibility
You must be at least 18 years old to use the Services. By using our platform, you represent and warrant that you meet this requirement.
1.2 Account Registration
To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information and to update it as necessary. You are responsible for maintaining your account confidentiality and notifying us immediately of any unauthorized use.
1.3 License to Use Services
We grant you a limited, non-exclusive, non-transferable license to access and use the Services, subject to compliance with these Terms.
1.4 Prohibited Conduct
You may not:
· Use the Services for unlawful purposes
· Violate local, cantonal, national, or international laws
· Upload or distribute harmful, offensive, or infringing content
· Interfere with the operation or security of the Services

2. Content on Homestaurants.com
2.1 User-Generated Content
Users may post menus, reviews, images, and other content (“User Content”). You retain ownership of your User Content but grant us a worldwide, royalty-free license to host, store, reproduce, modify, and display it for platform operations and improvements.
2.2 Our Rights
We reserve the right to remove or restrict access to User Content that violates these Terms, our policies, or applicable laws.
2.3 Intellectual Property
All content, trademarks, logos, and designs on the platform belong to us or our licensors. You may not use our intellectual property without prior written permission.
3. Orders and Payments
3.1 Order Acceptance
Submitting an order does not guarantee acceptance. Vendors may accept, modify, or reject orders at their discretion. Homestaurants.com is not involved in accepting, fulfilling, or delivering orders.
3.2 Payment Terms
All payments are directly between the customer and the vendor. Homestaurants.com does not:
· Process payments
· Hold or transfer funds
· Act as a payment intermediary
You acknowledge that Homestaurants.com is not responsible for payment disputes, fraud, overpayments, non-payment, or refunds. Any financial matters must be resolved directly between customer and vendor.
3.3 Taxes
Vendors and customers are individually responsible for compliance with all applicable Swiss taxes.
4. Disclaimers and Limitation of Liability
4.1 Service Availability
The Services are provided “as is” and “as available” without warranties. We do not guarantee uninterrupted, secure, or error-free operation.
4.2 Vendor Responsibility
Vendors are solely responsible for:
· Food safety, preparation, and hygiene
· Ingredient accuracy and allergen information
· Packaging and delivery
· Customer communication and service
Homestaurants.com does not inspect kitchens, verify compliance, or guarantee food quality or safety.
4.3 Limitation of Liability
To the fullest extent permitted under Swiss law, Homestaurants.com and its members shall not be liable for:
· Payment disputes or fraud
· Foodborne illness, allergic reactions, or contamination
· Indirect, incidental, or consequential damages
· Customer dissatisfaction or disputes with vendors
4.4 Third-Party Content
We are not responsible for the accuracy, reliability, or content of third-party websites or services linked to our platform.
5. Privacy
Your use of the Services is governed by our Privacy Policy, which explains how we collect, use, and protect personal information in accordance with Swiss law.
6. Modifications to Terms
We may update these Terms periodically. The “Effective Date” at the top reflects the most recent version. Continued use of the Services constitutes acceptance of updated Terms.
7. Termination
We may suspend or terminate your access to the Services at any time, with or without cause, and without liability. You may delete your account at any time.
8. Governing Law
These Terms are governed by Swiss law. Any disputes will be subject to the exclusive jurisdiction of the courts of Basel-Stadt, Switzerland.
